Terms and conditions

This English version is provided for convenience. In case of any difference, the French version prevails.

1. Role of the platform

Stradale connects rental businesses with renters. The platform is neither the owner, the keeper nor the insurer of the cars, and is not a party to the rental contract.

The rental contract is concluded directly between the owner and the renter. The platform provides the booking tool, oversees payment and keeps the check-in reports.

2. Sign-up and verification

Creating an account is free. To book, renters must have their driving licence verified by our provider Stripe Identity. Until this verification is complete, no booking request can be sent.

When listing a car, each owner declares that it is insured for rental to third parties. This declaration is their sole responsibility.

3. Booking

A booking request is not binding until the owner has accepted it. The owner has a set time to reply and may decline without giving a reason.

The owner freely sets their rate, deposit, minimum age, required years of licence and terms of use. Renters cannot book a car whose conditions they do not meet.

A rental cannot exceed 31 days.

4. Payment

When the booking is placed, the amount is held on the renter's card without being charged. The charge only takes place once two conditions are met: the owner has accepted the request, and the 72-hour withdrawal period has passed.

If the owner declines or does not reply, or if the renter withdraws before the charge, the hold is simply released: nothing is charged and the funds become available again without waiting for a refund.

Once charged, the funds are held by the platform and paid out to the owner after the end of the rental and the dispute period.

A service fee, paid by the renter, is added to the rate set by the owner. It covers the matchmaking, the verification of listings and licences, and the handling of payment. The price breakdown is shown before booking.

The platform keeps a commission on the owner's rate; the amount they will receive is shown to them when they set their rate. The owner receives the rest, paid out by our payment provider once the dispute period has passed. When the rental is paid in cash, the commission on the whole rate is deducted from the down payment made online.

Where the owner allows it on their listing, the renter may pay for the rental in cash. Only a down payment is then paid online — the service fee plus 30% of the rate — under the terms above; the balance is handed to the owner in person at key handover, and the platform takes no part in it. The owner is responsible for complying with the legal limits that apply to cash payments. If the renter does not show up, the down payment is kept; if the booking is cancelled, it is refunded under the cancellation terms, with the late-cancellation charge based on the full rate and capped at the part of the rate paid online.

Amounts are fixed at the time of booking. Any later change to the owner's rate has no effect on bookings already accepted.

5. Check-in reports

A report is drawn up when the car is handed over and when it is returned. It includes photographs of the car, of the driver's licence and ID, the mileage and the fuel level. It must be approved by both parties.

Without a check-in report, no deduction from the deposit can be justified.

The deposit stays held for 72 hours after the car is returned, so the owner can report damage that wasn't spotted on the spot. With no report within that window, it is released. If an issue is reported, it stays held until the platform decides, based on the condition reports and the photos.

6. Deposit

Its amount is stated on the listing. It is held on the renter's card the day before pick-up — held, never charged — so it is never asked for at the same time as the rental rate. On a long rental, the hold is renewed before it expires, without any further charge.

On return, if the check-in report records no damage, the hold is released: nothing has been charged. If damage is recorded, the platform reviews the reports approved by both parties and alone decides on any deduction, up to the amount stated; the rest of the hold is released. The owner takes nothing on their own, and without a check-in report no deduction can be justified.

7. Cancellation

Renters may cancel at any time before the rental starts. Within 72 hours of booking, cancellation is free and the refund is in full, service fee included.

After that, the service fee is retained by the platform: the file has been processed, the owner notified and the dates removed from the calendar, whether or not the rental takes place. The rental rate itself is refunded.

Less than 7 days before the start, a further 10% of the rental rate is retained: the owner has turned down other requests and no longer has time to rent the car out again.

If the owner declines the request, does not handle it, or cancels after accepting it, the renter is refunded in full, with no deduction.

8. Liability

The owner is responsible for the car's compliance, maintenance and insurance. The renter is responsible for its use during the rental period, and for fines and damage.

The platform's liability is limited to the operation of the matchmaking service. It is not liable for the condition of the cars, the performance of the rental contract, or disputes between the parties, although it may help resolve them.

9. Disputes

These terms are governed by French law. Any question can be sent to contact@drive-stradale.com.
